Citizens is looking for an experienced, highly motivated, and results-oriented attorney with strong professional credentials to join its Consumer Legal Team, supporting our high-growth point of sale lending business, Citizens Pay. This business unit is a “fintech in a bank”, a true innovator and disruptor in the payments and lending industry, and boasts some of the largest retailers in the country (e.g., Apple, Microsoft) and the group is rapidly expanding its merchant portfolio across industry verticals including electronics, specialty retail, home goods & home improvement, travel & entertainment, and medical.
As Counsel to Citizens Pay, you will provide practical advice to a collaborative, innovative cross-functional team on complex legal and regulatory matters related to point of sale lending products. You will partner with the business to inform the end-to-end design and development of the new financial products and offer immediate and direct legal support on all aspects of the business, including marketing, servicing, operations, and product development, and promote the growth of the business through drafting and negotiating contracts with strategic merchant partnerships.
Primary responsibilities include:
Research, analyze and provide sound legal advice on legal and compliance matters related to existing and evolving financial products and services
Draft, review, update, and negotiate foundational documents for products and services (e.g., customer agreements, terms of service, regulatory disclosures, etc.), as well as partnership agreements with merchant clients and third-party technology service providers
Review multi-channel advertising materials for compliance with federal and state laws and best practices
Monitor the evolving regulatory landscape for changes that may impact Citizens Pay’s lending, finance and payments products
Advise senior management and functional partners on risk issues and help to devise practical approaches to their mitigation
Collaborate with other members of the Citizens Legal and Risk teams to leverage internal subject matter expertise on product, payments, labor and employment, intellectual property, privacy, and cybersecurity, and integrate input into FinTech solutions
Required: J.D. and license to practice law in a U.S. jurisdiction.
Required: At least 6 years of practical hands-on legal experience advising corporate clients on issues related to unsecured lending products, preferably at both in-house experience at a large financial service or fintech company and a national law firm
Required: Strong knowledge of financial regulations, including deep expertise in laws related to consumer open and closed-end credit, card association and payment network rules, money transmission, financial advertising, and CFPB regulations
Required: Ability to develop creative and adaptive solutions to unique and complex product design inquiries, with a focus on balancing important legal risks for the business
Required: Ability to work autonomously and independently while remaining a team player with a positive attitude and good sense of humor
